1. Acceptance of Terms

By accessing or using MINC DATA LLC ("MINC DATA," "we," "us," or "our") products and services, including the Global Pollen Tracker browser extension (the "Extension"), our website, and any related content (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services.

You must be at least 13 years old to use the Services.

2. Description of Services

MINC DATA provides tools for environmental awareness and decision support, including weather and pollen-related features.

We may modify, suspend, or discontinue any part of the Services at any time, including adding or removing features, changing content, or updating availability.

3. Accounts; No Medical Advice

No account required (unless we later introduce optional accounts for paid features).

The Services are provided for informational purposes only and are not medical advice. Always consult qualified professionals for health-related decisions.

4. License and Permitted Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use, subject to these Terms.

You agree not to:

• use the Services for unlawful purposes;
• interfere with, disrupt, or attempt unauthorized access to the Services;
• reverse engineer, decompile, or attempt to extract source code except to the extent permitted by law;
• misuse the Services in a way that could harm MINC DATA, our users, or third parties.

5. Paid Features, Subscriptions, and Donations

The Services may include free and paid features ("Paid Services"), including subscriptions. We may also offer optional donations/tips.

5.1 Subscriptions and Auto-Renewal

If you purchase a subscription, it may automatically renew until cancelled. We will present the material subscription terms (price, billing frequency, renewal terms, and how to cancel) clearly at checkout.

Cancellation: You may cancel at any time through the method provided at purchase. Cancellation takes effect at the end of the current billing period.

Renewal reminders: Where required by applicable law, we will provide renewal reminder notifications.

5.2 Free Trials / Promotional Pricing

If a subscription begins with a free trial or promotional period, your subscription will convert to a paid subscription unless you cancel before the trial ends.

5.3 Refunds

Unless otherwise required by law, all fees are non-refundable. If you purchased through a third-party platform (e.g., a browser marketplace), refunds are governed by that platform's policies.

5.4 Taxes

Prices may exclude applicable taxes unless stated otherwise. You are responsible for any applicable taxes.

5.5 Donations / Tips

Donations/tips are voluntary payments intended to support development. They are not charitable donations, are not tax-deductible, and are generally non-refundable unless required by law.

6. Advertising

We may display advertising within the Services. Ads may be served by third-party advertising partners.

We do not allow advertising partners to collect or use data in ways that violate our Privacy Policy.

The Extension is not designed to collect or use your browsing history for ad targeting, and any advertising practices must comply with Chrome Web Store policies on user data.

7. Privacy

Your use of the Services is subject to our Privacy Policy, which is incorporated by reference. If there is a conflict between these Terms and the Privacy Policy regarding data handling, the Privacy Policy controls.

8. Third-Party Data Sources; Third-Party Links

The Services may rely on third-party data sources (e.g., weather and pollen providers). We do not control and are not responsible for the accuracy, completeness, or availability of third-party data.

The Services may include links to third-party websites or services. We do not endorse and are not responsible for third-party content, products, or services.

9. Intellectual Property

All content, software, and materials in the Services are owned by MINC DATA or its licensors and are protected by intellectual property laws. "MINC DATA" and related logos are trademarks of MINC DATA LLC.

You may not copy, modify, distribute, sell, lease, or create derivative works of the Services except as explicitly permitted by these Terms.

10. Feedback

If you submit ideas, suggestions, or feedback, you grant MINC DATA a worldwide, perpetual, irrevocable, royalty-free license to use them without compensation or obligation to you.

11. Disclaimer of Warranties

The Services are provided "as is" and "as available." To the maximum extent permitted by law, MINC DATA disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Services will be uninterrupted, error-free, accurate, or completely secure. Environmental data, including pollen and weather information, may be delayed, incomplete, or inaccurate.

12. Limitation of Liability

To the maximum extent permitted by law, MINC DATA will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, use, goodwill, or other intangible losses, arising from or related to your use of the Services.

In no event will MINC DATA's total liability for all claims relating to the Services exceed the amount you paid to MINC DATA for the Services in the 12 months preceding the event giving rise to the claim, or $100 if you paid nothing.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless MINC DATA and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your infringement of any rights of a third party.

14. Termination

We may suspend or terminate your access to the Services at any time if we reasonably believe you violated these Terms or if we must do so to comply with law or protect the Services and users.

Upon termination, your right to use the Services will cease immediately.

15. Governing Law; Venue

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law rules. You agree that any dispute not subject to arbitration will be brought in the state or federal courts located in Massachusetts, and you consent to personal jurisdiction there.

16. Changes to Terms

We may update these Terms from time to time. We will post the updated Terms and revise the "Last updated" date. If changes are material, we may provide additional notice through the Services or by other reasonable means. Your continued use after changes become effective constitutes acceptance.
